You must have an open family court case before you can file for custody and visitation. During the filing of one of the family law cases below, the attorney will file an Order to Show Cause requesting Child Custody and Visitation.
The court will set a hearing date, but before the hearing the parties must go to mediation at Family Court Services. At mediation, both parties will meet with a mediator together (unless Domestic Violence is alleged) and share his/her concerns regarding custody and visitation.
