California Child Custody & Visitation Laws

You must have an open family court case before you can file for custody and visitation. During the filing of one of the family law cases below, the attorney will file an Order to Show Cause requesting Child Custody and Visitation.

The court will set a hearing date, but before the hearing the parties must go to mediation at Family Court Services. At mediation, both parties will meet with a mediator together (unless Domestic Violence is alleged) and share his/her concerns regarding custody and visitation. The mediator will then make recommendations to the court as to what she thinks is the best plan for the child.

The type of family law court case you can open depends on whether or not you are married to the other parent or have a registered domestic partnership.

If you are married to the child’s other parent or are a registered domestic partner of the child’s other parent, you may request custody and visitation orders in the following types of family law court case:

  • Petition for Divorce, Legal Separation, or Annulment;
  • Domestic Violence Restraining Order;
  • Petition for Custody and Support of Minor Children;
  • Or you may open a case through the County Department of Child Support Services.

If you are NOT married to the other parent or are not registered domestic partners, you may request custody or visitation orders in the following types of family law court case:

  • Parentage Case;
  • Domestic Violence Restraining Order;
  • Petition for Custody and Support of Minor Children.
  • Or you may request custody or visitation orders through an open County Department of Child Support Services case.
